Terms and Conditions for Students
By enrolling in lessons, you acknowledge and agree to the following terms and conditions between you and your tutor.
1. Lesson Enrolment
- Lessons are available on a one-to-one or group basis.
- Enrolment is confirmed once (1) sign up form has been completed, (2) Direct Debit details are set up, and (3) lesson fees are received.
- Lesson schedules are arranged based on tutor and student availability.
- By enrolling, students and parents/guardians agree to abide by these Terms and Conditions.
2. Agency Relationship
- Parkland Music acts as an agent on behalf of the tutors for the arrangement and administration of music lessons.
- All lesson fees are collected by Parkland Music on behalf of the tutor and administers payments, scheduling, and related services as the tutors' agent.
- Tutors are independent contractors, not employees of Parkland Music.
- Parkland Music is responsible for scheduling, communication, and fee collection, but is not liable for any personal actions or omissions of individual tutors.
- All tutors are DBS checked, verified, and approved by Parkland Music to ensure quality and safety standards.
3. Payment and Fees
- Trial Lessons: All trial lessons must be paid in full at the time of booking via card or online payment.
- Ongoing Enrolment: For any enrolment, the student must commit to a minimum of four (4) lessons. Fees are collected via either Direct Debit or a three-month upfront payment.
- Monthly Billing: Lesson fees are charged monthly based on the number of lessons scheduled in that calendar month. If a calendar month contains fewer than four (4) lessons, the balance will be combined and charged with the following month’s invoice.
- Late Payments: Parkland Music reserves the right to apply a £15 administrative fee to any account with overdue payments. This fee covers the reasonable costs of payment processing, debt recovery, and administration required to manage arrears.
- Arrears and Suspension: The student's account will be suspended if it remains in arrears. This suspension does not waive the student's liability for outstanding fees or the requirement for a one-month notice period for termination.
- Refund Policy: Once charged, all fees are non-refundable at discretion.
4. Cancellations and Rescheduling
- Notice Period: A minimum of 24 hours’ notice is required to cancel or reschedule a lesson. Cancellations made with less than 24 hours’ notice will be charged in full.
- Tutor Cancellations: If a tutor is unable to teach a certain lesson, the tutor will ensure all the missed lesson time will be compensated in one of the following ways:
· Rearranging the full lesson, or
- Extending future scheduled lessons by 15-minute increments, or
- Appointing another substitute tutor to deliver the lesson.
Any unfulfilled lesson time will be issued as credits to the student's account which can be used within the calendar year.
- Student Rescheduling: Make-up lessons are subject to the tutor's availability and must be completed within four weeks in one of the following ways:
· Rearrange the full lesson without affecting other scheduled lessons, or
· Extend future scheduled lessons by 15-minute increments, or
· Attend a lesson by a substitute tutor appointed by your Tutor.
If the student is unable to arrange a make-up session within the four-week period, the lesson will be forfeited without a refund at discretion.
5. Lesson Terminations
- Notice Period: Any student or tutor wishing to discontinue lessons must provide at least one (1) month’s written notice prior to the last lesson. Notice must be sent to wa14@parklandmusic.co.uk and no verbal notice will be accepted.
- Billing During Notice: Lessons within the notice period will remain billable and payable throughout the notice period.
- Unused Credits: Any unused lessons or credits remaining at the time of termination are non-refundable and non-transferable.
- Right to Terminate: The tutor reserves the right to terminate lessons immediately in cases of non-payment, student misconduct, or breach of these terms.
6. Attendance and Punctuality
- Students should arrive on time for their scheduled lessons.
- Lessons will end at the scheduled time regardless of late arrival.
- Frequent absences may result in loss of the reserved time slot.
7. Lesson Conduct
- Students are expected to behave respectfully toward all tutors and staff.
- Food and drinks (other than water) are not permitted during lessons.
- Mobile phones must be kept silent during lessons.
8. Tutor Substitution and Flexibility
- The tutor may assign a substitute tutor in case of their unavailability. The substitute tutor will need to be checked for their enhanced DBS status and right to work before the lesson.
- Students may request to change tutor only when all the paid lessons with that tutor are completed.
9. Instruments and Equipment
- Students are responsible for bringing their own instruments to lessons (except for piano, drums, or other in-house equipment).
- For online lessons, students must ensure a stable internet connection and proper audio setup.
10. Product Recommendations and Commission
- Tutors may occasionally recommend musical instruments, accessories, or learning materials to support student progress.
- Some tutors may receive a commission or referral incentive for promoting or selling such products.
- All recommendations are made in good faith based on the tutor’s professional opinion and experience.
- Students and parents are under no obligation to purchase any product recommended by tutors or Parkland Music.
11. CCTV Monitoring
- Closed-Circuit Television (CCTV) is in operation in certain teaching and communal areas for safety, security, and safeguarding purposes.
- CCTV recording is carried out in compliance with the UK Data Protection Act 2018 and UK GDPR.
- The use of CCTV is strictly for ensuring the safety of students, tutors, and property; recordings are not used for lesson evaluation or marketing.
- CCTV footage is stored securely, retained for a limited period, and accessed only by authorised personnel when necessary.
- By attending lessons, students and parents/guardians acknowledge and consent to the use of CCTV as described.
12. Photography and Media
- Photos or videos may occasionally be taken during lessons or events for promotional use (social media, website, or printed materials).
- Students who do not wish to appear in any media must notify Parkland Music in writing in advance.
13. Health and Safety
- Parkland Music follows all relevant health and safety regulations.
- Parents/guardians must inform Parkland Music of any medical conditions or allergies that could affect participation.
- Reasonable care will be taken to provide a safe environment for all students.
14. Liability
- Parkland Music is not responsible for loss or damage to personal belongings.
- Students under the age of 11 years should not leave the centre unaccompanied. Parents or guardians are responsible for arranging timely collection at the scheduled end time of the lessons. Outside scheduled lesson time, neither the tutors nor Parkland Music shall be responsible for the supervision or care of the students.
- Parkland Music’s total liability is limited to the value of lessons paid for but not yet delivered.
15. Policy Updates
- Parkland Music reserves the right to update or amend these Terms and Conditions at any time.
- The latest version will always be available on our website or upon request.
